Privacy Policy

1. Personal Information

zenite (owned by Aerium S.P.) (herein referred to as "zenite") collects and stores personal information, including: full name, company name, address, city, zip code, country, VAT ID, credit card number, CVV, credit card expiration date, email address, source IP address, client device information, client browser information, for all customers. Inquiries regarding the collection and use of personal information may be made via email to support@zenite.io, or via postal mail or facsimile using contact information found on our Contact page.

2. Security and Data Integrity

Customer information is stored in electronic databases, on our main zenite VPS server provided by Linode LLC. zenite employs industry-standard technical safeguards, including but not necessarily limited to encryption of credit card information, password and/or cryptographic key-based authentication controls on servers which house personal information, browser-based SSL encryption, and other storage system access control mechanisms to protect the integrity of internal databases and prevent unauthorized access.

3. Third Party Disclosure

zenite transfers personal information to third parties under the following normal business procedures: (i) zenite discloses the e-mail address and credit card account information of its customers to a third party merchant processing provider for billing purposes. (ii) zenite discloses the e-mail address, full name, country, browser information, device information, and IP address to a third party provider for login purposes. (iii) If the social network account (Facebook, Google, Microsoft Live) is used to register or login to zenite services, zenite discloses the public profile information of that account to a third party provider for login purposes. If the social account provider requires user permission to allow zenite to access the public profile information, you will be asked to give such permission when logging in. zenite does not disclose customer information to other third parties except where required under applicable state and federal laws for purposes of investigation of criminal complaints, or where required by court order.

4. Security

Customers bear sole responsibility for maintaining the security of the server environments maintained under their accounts. Customers are solely responsible for ensuring compliance with any and all applicable privacy guidelines and regulations for all jurisdictions in which they may operate with respect to appropriate practices for the collection, storage, and dissemination of personal information using their zenite server. In no event shall zenite be held liable for a customer's failure to adopt and/or practice appropriate measures for safeguarding personal information stored within or transmitted through their zenite server.

5. Account Cancellation

If the customer requests the account cancellation, all due costs must be paid before such cancellation can occur. If the account is successfully cancelled, all personal information about the customer is purged from our servers. A request will be sent by zenite to third party providers to purge the personal information from their services. zenite cannot be held responsible for failure of the third-parties to purge the personal information on their services.

6. Cookies

This service may employ third party tracking cookies to gather anonymous browser, operating system, geographic, and web site navigation information. Use of our zenite web interface requires the acceptance of cookies for login session management purposes.

7. Notices

You agree that zenite may provide you with notices, by email, regular mail, or postings on zenite services. You agree that zenite shall send invoices as attachments by e-mail. Attached invoices may contain personal information.

8. Changes

Amendments to this privacy policy may be made at any time and you should check back frequently for any changes. zenite will never make changes to this policy that result in less protection of your personal information without sending notice. This policy was last updated on Jan 30th, 2018.

Billing, Refund and Cancellation Policy

1. Invoicing and Payment

You agree that zenite shall be permitted to charge your credit card on a monthly, annual, or other agreed upon basis in advance of providing services. Payment is due upon invoicing. Service may be interrupted on accounts that reach 10 days past due.

2. Refunds and Cancellations

Any previously invoiced costs are non-refundable. In case of account termination, any and all fees owed to zenite before such termination shall be immediately due and payable.

Terms of Service

1. Backups and Data loss

You agree that your use of zenite services is at your own risk, and that zenite is not liable for any data loss in connection with its services. You are solely responsible for creating backups of your content. If, during our own routine maintenance, we do create a backup of your content which you later request us to restore to your account, we cannot guarantee that we will be able to do so, or that your content will be unharmed as a result of the initial data loss or the subsequent restore procedure. To that end, we highly recommend that you establish your own routine backup procedure and that you periodically test restoring files from your backup media to ensure that you are making viable backups.

2. Service Level Agreement

zenite provides a 99.9% uptime guarantee on all hardware, and on network connectivity. In any given month, if your zenite server is down for more than 0.1%, you may request a pro-rated credit for the down-time.

3. Price Change

We reserve the right to change prices listed on zenite.io at any time, without notice, and the right to modify the amount of resources given to plans at any time. In case of pricing changes, servers that have been running prior to the price change will not be affected and will continue to adhere to the the original pricing (the prices that have been defined when the server was deployed).

4. Rules of Conduct

You agree that you will not transmit, distribute, post, store, link, or otherwise traffic in content, information, software, or materials on or through the Service that (i) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, offensive, profane, contains or depicts pornography that is unlawful, or is otherwise inappropriate as determined by us in our sole discretion, (ii) you know is false, misleading, untruthful or inaccurate, (iii) constitutes unauthorized or unsolicited advertising, (iv) impersonates any person or entity, including any of our employees or representatives, or (v) includes anyone's identification documents or sensitive financial information.

5. Account Suspension

zenite reserves the right to suspend network access to any customer if, in the judgment of the zenite network administrators, the customer's server is the source or target of a violation of any of the other terms of service or for any other reason which zenite chooses. zenite will use reasonable care in notifying the customer and in resolving the problem in a method resulting in the least amount of service interference. zenite reserves the right to terminate service without notice for continued and repeated violations of the terms of service. If inappropriate activity is detected, all accounts of the customer in question will be deactivated until an investigation is complete. Prior notification to the customer is not assured. In extreme cases, law enforcement will be contacted regarding the activity. The customer will not be credited for the time the customer's machines were suspended.

6. Limitation of Liability

You acknowledge that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of zenite and that damages resulting from any interruption of service are difficult to ascertain. Therefore, you agree that zenite shall not be liable for any damages arising from such causes beyond the direct and exclusive control of zenite. Subscriber further acknowledges that zenite's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall zenite be liable for any special or consequential damages, loss or injury. zenite is not responsible for any damages your business may suffer. zenite does not make implied or written warranties for any of our services. zenite denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by zenite.

7. Warranty Disclaimer

You agree that your use of zenite shall be at your sole risk. All services provided by zenite are available as is, without warranty.
